Terms of Service

Welcome to TrendKeep. These Terms are the agreement between you and us for your use of TrendKeep. Please read them carefully. Our Privacy Notice explains how we handle your personal data.

1. Who we are

TrendKeep is provided by Llee Tossel, a private individual based in the Netherlands, as a free, non-commercial service ("we", "us"). You can reach us at privacy@trendkeep.nl. TrendKeep is not run by a registered company. If a company is registered to run TrendKeep, we will update these Terms with its details and let you know before the change takes effect.

2. What TrendKeep is

TrendKeep is a web app (at trendkeep.nl) that lets you log your body weight and shows you a smoothed trend of your weigh-ins over time, along with your progress towards a goal you set yourself.

TrendKeep is currently in a soft launch. We are still improving it, so features may change and things may sometimes go wrong. TrendKeep is free during the soft launch. If we ever introduce paid features, we will tell you in advance. You will never be charged without agreeing to it first.

3. Not medical advice

TrendKeep is not a medical device and does not give medical advice.

  • The trends, averages, goal progress and pace estimates in TrendKeep are general information based on the numbers you enter. They are not a diagnosis, treatment or recommendation for your health.
  • TrendKeep does not replace a doctor, dietitian or other qualified health professional. Talk to one before you make significant changes to your diet, exercise or weight, especially if you are pregnant, have a medical condition, take medication, or have (or have had) an eating disorder.
  • If you have concerns about your health, contact your doctor (huisarts). In an emergency, call 112.
  • The goal weight and pace you choose are your own decisions. Weight changes much faster or slower than about 0.5–1% of body weight per week can be a sign that you need professional advice.

4. Who can use TrendKeep

  • You must be at least 16 years old to create an account and use TrendKeep. By signing up, you confirm that you are 16 or older.
  • You may only create an account for yourself, not for another person.
  • If we learn that a user is under 16, we will close and delete the account.

5. Your account

  • You sign up with an email address and a password of at least 8 characters. Keep your password secret and do not share your account.
  • You are responsible for what happens under your account, unless it is caused by our own fault or failure.
  • If you think someone else has accessed your account, change your password immediately and email privacy@trendkeep.nl.
  • When you sign up, you also decide whether to give your explicit consent for us to process your health data. TrendKeep cannot work without it. See section 4 of our Privacy Notice.

6. Your data and content

  • Your data stays yours. You keep all rights to the weigh-ins, notes and other information you enter ("your content").
  • You allow us to store and process your content only for as long as needed to provide TrendKeep to you, as described in our Privacy Notice. We do not sell your content or use it for advertising.
  • Download your data, withdraw consent and delete your account in Settings → Privacy are coming soon. Until then, email privacy@trendkeep.nl and we'll handle your request within one month.
  • Please make sure the information you enter is your own and does not contain other people's personal data or anything unlawful.

7. Acceptable use

When you use TrendKeep, you agree not to:

  • break the law or anyone else's rights;
  • try to access other users' accounts or data, or bypass our security;
  • probe, scan or test the vulnerability of TrendKeep without our written permission. If you find a security issue, please report it to privacy@trendkeep.nl; we appreciate responsible disclosure;
  • overload or disrupt TrendKeep, for example with automated scraping, bots or excessive API requests;
  • copy, resell or reverse-engineer TrendKeep, except where the law allows it;
  • use TrendKeep to store content that is illegal, harmful or unrelated to tracking your own weight.

8. Availability and changes to TrendKeep

  • We work hard to keep TrendKeep available and your data safe, but we cannot promise that TrendKeep will always be available, uninterrupted or free of errors, especially during the soft launch.
  • We may change, add or remove features. If a change significantly affects how you use TrendKeep, we will tell you in advance where reasonably possible.
  • We back up our data regularly.

9. Ending your use of TrendKeep

  • You can stop using TrendKeep at any time. Deletion is permanent and cannot be undone. How to download your data, withdraw consent or delete your account is in section 8 of our Privacy Notice.
  • We may suspend or close your account if you seriously or repeatedly break these Terms, if the law requires it, or to protect TrendKeep or other users. Unless there is an urgent reason, we will warn you first.
  • If we decide to stop offering TrendKeep altogether, we will give you at least 30 days' notice by email.
  • When your account ends, we delete your data as described in our Privacy Notice.

10. Liability

  • TrendKeep is provided free of charge and "as is". To the extent the law allows, we are not liable for indirect or consequential damage, or for decisions you make based on the information in TrendKeep (see section 3).
  • To the extent the law allows, our total liability to you is limited to €100.
  • Nothing in these Terms limits our liability for damage caused by our intent or gross negligence (opzet of bewuste roekeloosheid), for death or personal injury caused by our fault, or in any other case where the law does not allow liability to be limited. Your mandatory rights as a consumer and your rights under the GDPR also remain unaffected.

11. Changes to these Terms

We may update these Terms, for example when we add features or when the law changes. We will tell you about important changes at least 30 days before they take effect, by email or in the app. If you do not agree with the new Terms, you can end your account before they take effect, as described in section 8 of our Privacy Notice. If you keep using TrendKeep after they take effect, the new Terms apply. Changes needed for legal reasons or for new features may apply sooner.

12. Governing law and disputes

  • These Terms are governed by Dutch law.
  • If you have a complaint, please email privacy@trendkeep.nl first. We'll respond as soon as possible and try to find a solution with you.
  • If we cannot resolve it together, disputes go to the competent court in the Netherlands. If you are a consumer living in another EU country, you keep the protection of the mandatory rules of that country, and you can also bring a claim in the courts where you live.
  • For privacy complaints, you can also contact the Autoriteit Persoonsgegevens (see our Privacy Notice).

13. Other terms

  • If any part of these Terms turns out to be invalid, the rest stays in force.
  • These Terms and our Privacy Notice together are the whole agreement between you and us about TrendKeep.
  • We may transfer this agreement to a successor of TrendKeep, for example after a sale or merger, provided your rights under these Terms are not reduced. We will tell you if that happens.
